Columbus, OH – 5.28.2024 – I am writing today with an important update on ballot access for President Biden and Vice President Harris. Despite Governor DeWine calling a special session of the state legislature, we have no confidence that the next two days will produce a clean bill to get the President on the ballot. Ensuring ballot access for President Biden was just too important to leave it in the dysfunctional hands of the Ohio GOP.

At 1pm this afternoon, the DNC announced plans to certify President Biden and Vice President Harris through an internal party process (more on that in the notes below). Chairman Harrison has our full support in this effort, and we will continue to work closely with our colleagues at the DNC and on the Biden Campaign in the weeks ahead.

Below please find the statements and background that have been shared with national and in-state media.

Thanks for all you are doing to support Democrats up and down the ballot.

Statement from DNC Chair Jaime Harrison:

“Joe Biden will be on the ballot in Ohio and all 50 states, and Ohio Republicans agree. But when the time has come for action, they have failed to act every time, so Democrats will land this plane on our own. Through a virtual roll call, we will ensure that Republicans can’t chip away at our democracy through incompetence or partisan tricks and that Ohioans can exercise their right to vote for the presidential candidate of their choice.”

Statement from OH Dems Chair Liz Walters:

“Once again, Republican politicians at the statehouse are playing politics with our democracy by trying to prevent Ohio voters from choosing who they want to be president, but Democrats will not trade Ohioans’ ability to hold their government accountable for presidential ballot access. Just like when they attempted to take away our rights and freedoms last year, Ohio Republicans have shown their blatant disregard for the rights of voters, and we won’t let them get away with another effort to hold our democracy hostage.”

Statement from Justin Levitt, Professor of Law at Loyola Marymount University:

“It is unimaginable that a major party candidate for president would be kept off the ballot in a context like Ohio has created, without any legitimate reason, and when literally every other state has come around. So in addition to being an unprecedented distraction, this petty partisanship is bound to fail. Both candidates will inevitably be on the ballot; the only real question is whether Ohio’s legislators and secretary of state will feel any shame for lighting their constituents’ tax dollars on fire in the meantime.”

Background on DNC process for virtual roll call:

  • Because of the partisan obstructionism of Ohio Republicans, the DNC will move to conduct virtual party proceedings to certify President Biden and Vice President Harris as the Democratic Party nominees before Ohio’s August 7 deadline, and before our in-person Convention programming beginning August 19.
  • We’ve done this before. There is strong, effective precedent for this process – these virtual party proceedings will closely mirror the successful process used in the 2020 convention.
  • Conducting a virtual roll call will require the following steps:
    • 1) The Rules and Bylaws Committee will vote on Tuesday, June 4 on a resolution to propose changes to the Call to allow for virtual party proceedings:
    • 2) In the coming weeks, the resolution will be voted on by the full DNC membership.
    • 3) Once the resolution is adopted, the remainder of the pre-nomination process will follow the standard order of operations.
  • In spite of Republicans’ bad-faith efforts to stand in the way, the in-person Convention in Chicago will continue to serve as an important convening event for Democrats across the country.
